The European Banking Authority has acknowledged the European Commission’s decision not to adopt proposed amendments to Commission Delegated Regulation (EU) No 241/2014, which aimed to shorten processing times for reducing own funds and eligible liabilities instruments.
European Commission Decision on Draft Regulatory Technical Standards
The European Banking Authority (EBA) confirmed on 9 September 2026 that the European Commission decided not to endorse draft Regulatory Technical Standards (RTS) submitted by the banking supervisor on 19 March 2026.
The draft RTS contained targeted amendments designed to shorten application periods for institutions seeking prior permission to reduce own funds and eligible liabilities instruments. The targeted measures aimed to address concerns from both industry stakeholders and competent authorities, who considered application timelines under the 2021 RTS framework unnecessarily lengthy.
Broader Regulatory Review Planned
In response to the Commission’s decision, the EBA stated that it will follow the European Commission’s proposal to execute a broader review of the technical standards.
This comprehensive review will seek to deliver additional simplification and efficiency gains for credit institutions and supervisory authorities at a later date.
