CVM Updates Rules on Credit Information System Access and Reporting

Brazil's Securities and Exchange Commission (CVM) has issued Resolution CVM 247 to regulate how credit transaction data is submitted to and accessed within the Credit Information System (SCR), which is managed by the Central Bank of Brazil (BCB).

New Reporting Obligations and Access Rights

Issued on 5 October 2026, Resolution CVM 247 amends Resolution CVM 60 and Normative Annex II of Resolution CVM 175. The regulatory changes stem from a Technical Cooperation Agreement signed between CVM and BCB to strengthen joint oversight and improve the supervision of financial and capital markets. CVM President Otto Lobo noted that the information-sharing initiative enhances the operational reach of both authorities.

The new framework establishes a monthly requirement for securitisation companies to report their credit transaction data to the SCR. For credit rights investment funds (FIDCs), the regulation refines existing reporting rules for administrators and permits fund managers to directly consult SCR records to assess borrower indebtedness and credit risk.

Adaptation Timeline and Regulatory Procedure

Securitisation companies have been granted a 12-month transition window to comply with the new reporting obligations. FIDC administrators, who are already sending information to the system, receive no additional adaptation period.

Resolution CVM 247 enters into force on 1 November 2026. CVM enacted the measure without prior Regulatory Impact Analysis (AIR) or public consultation, relying on provisions within Decree 10.411 that allow exemptions for measures executing inter-agency cooperation agreements intended to safeguard market integrity.
