ESMA Consults on Reporting Framework for Third-Country CCP Clearing Activity

The European Securities and Markets Authority has launched a public consultation on a proposed annual reporting framework under the European Market Infrastructure Regulation, covering clearing activity at recognised third-country central counterparties.

Reporting Requirements and Supervisory Visibility

The consultation paper details proposed Regulatory Technical Standards and Implementing Technical Standards under EMIR to increase supervisory visibility regarding EU entities' exposures to recognised central counterparties operating outside the European Union. The reporting mandate will apply directly to clearing members and clients that process transactions through recognised third-country CCPs.

This supervisory framework forms part of the broader monitoring structure established under EMIR 3. The primary objective is to equip financial authorities with a consistent and structured overview of the scale, characteristics and risk profile of EU firms' exposures. Following implementation, the measure will introduce a harmonised reporting approach across member states.

Data Reuse and Feedback Deadline

In accordance with ESMA's agenda for administrative simplification and burden reduction, the proposal prioritises reusing information already collected through current reporting mechanisms. Additional requirements are confined to specific information that is not currently accessible to ESMA or national competent authorities.

Stakeholders are requested to submit responses concerning the proposed reporting framework, associated templates and technical formats by 12 October 2026. Once the consultation closes, ESMA will examine the submitted feedback and draft its Final Report.
